Air Polution Control

Air Pollution Control
Air pollution control involves prevention and tackling of pollution, recovering of air quality by doing inventory on ambient air quality, prevention of pollutant source from non-stationary and stationary sources including disturbance source, as well as tackling of emergency situation.

  • The preparation and implementation of technical policy for national air pollution control shall be determined by the Head of responsible agency.
  • The technical policy and implementation of air pollution control as referred to subsection (1) shall be reviewed after 5 (five) years.
  • The operational implementation of air pollution control in region shall be done by the Regent/Mayor of 2nd level region.
  • The implementation of operational coordination for air pollution control in region shall be done by the Governor.
  • In the event preparation and operational implementation of air pollution control in region as referred to Section 18 subsection (1), region shall prepare and determine the regional work program for air pollution control.
  • The provision regarding guidelines for preparation and operational implementation of air pollution control in region as referred to subsection (1) shall be determined by the Head of responsible agency.

Air Pollution Prevention and Environmental Structuring Requirements
Air pollution prevention involves the activities to prevent air pollution by:

  • Determination of ambient air quality standard, stationary source emission quality standard, disturbance level standard, vehicular exhaust gas emission and noise level standards as referred to Chapter II of this Government Regulation;
  • Determination of air pollution control policy as referred to sections 17, 18, and 19.
Every person doing business and/or activity producing emission and/or disturbance to the ambient air shall:
  • Follow ambient air quality standard, emission quality standard, and disturbance level standard determined for the business and/or activity done;
  • Prevent and/or tackle air pollution caused by the business and/or activity done;
  • Provide correct and accurate information to the public in the event of tackling of air pollution in the business and/or activity.
  • Every person doing business and/or activity producing emission and/or disturbance from stationary source shall follow emission quality and disturbance level requirements determined in the operation permit.
  • Operation permit as referred to subsection (1) shall be issued by the authorized official in accordance to the legal regulation.
  • Every business and/or activity that shall have environmental impact assessment shall not produce emission that exceeds the emission quality limit determined in its operation permit.
  • For every business and/or activity that shall has environmental impact assessment, the authorized official issuing operating permit shall require the body responsible for the business and/or activity to comply the provision of emission quality standard and/or disturbance level standard for preventing and managing air pollution caused by the implementation of the business and/or activity.
  • Further provisions regarding the requirements and obligations for emission quality standard and/or disturbance level standard as referred to subsection (1) shall be determined by the Head of responsible agency.
  • Obligation as referred to subsection (2) shall be attached as provision in the operating permit.
